Judgment text excerpt
The Supreme Court examined the jurisdiction of the National Consumer Disputes Redressal Commission under the Consumer Protection Act, 1986 (C P Act) in relation to the Carriage by Air Act, 1972 (CA Act) and the Warsaw Convention of 1929. The Court held that the National Commission has the authority to entertain complaints regarding deficiency of service by an international cargo carrier, despite the existence of international conventions governing air transport. The appellant was directed to compensate the consignor for the deficiency of service, affirming the applicability of domestic consumer laws alongside international conventions.
