The Supreme Court upheld the High Court's order directing the Central Industrial Security Force (CISF) to consider the respondent for promotion to Head Constable from 1998 onwards, as he had completed ten years of service and was eligible under the relevant rules. The Court found that the Departmental Promotion Committee (DPC) had improperly excluded him from consideration based on his previous punishments, which did not justify ignoring his eligibility. The Court emphasized that all eligible Constables, including those not promoted to Lance Naik, should be considered for promotion as per the established rules.
