The Supreme Court held that the High Court erred in directing the appointment of the respondent as a Constable while a criminal case under Sections 148, 323, 380, 448, 427, and 506 IPC was pending against him. The Court emphasized that the authorities have a duty to verify the antecedents of candidates for police appointments and that a candidate cannot be deemed suitable for appointment until acquitted of pending criminal charges. Consequently, the Court set aside the High Court's order and dismissed the writ petition under Articles 226/227 of the Constitution.
