The Supreme Court ruled that Rules 6(h) and 32(g) of the Bar Council of Maharashtra and Goa Rules are ultra vires the powers of the State Bar Council as they infringe upon the authority granted to the Bar Council of India under Section 49(1)(a) of the Advocates Act, 1961. The Court held that the State Bar Council can only make rules for the election of its members and for the preparation and revision of electoral rolls, not for voter qualifications or disqualifications. Consequently, the elections held on 04.03.2004 were set aside due to the invalidity of these rules.
