Judgment text excerpt

The Supreme Court held that under Section 18 of the Hindu Adoptions and Maintenance Act, 1956, the appellant was not entitled to an injunction against the alienation of the suit property after the dissolution of marriage. The Court affirmed the High Court's decision that the appellant's right to reside in the property ceased with the divorce decree, as there was no stipulation in the decree allowing her to remain in possession. Consequently, the Court upheld the order vacating the injunction against the respondent's alienation of the property.
