Judgment text excerpt

The Supreme Court held that under Section 18 of the Hindu Adoptions and Maintenance Act, 1956, the appellant is entitled to reside in the suit property only as long as the marriage is intact. Following the decree of divorce under Section 13 of the Hindu Marriage Act, 1955, the appellant's right to occupy the property ceased, and the learned Single Judge's decision to vacate the injunction against alienation was upheld. The Court concluded that the appellant cannot claim any right to the property post-divorce, affirming the lower court's ruling.
