Judgment text excerpt

The Supreme Court upheld the Kerala High Court's decision declaring the election of the appellant void under Section 100(1)(a) and (d)(i) of the Representation of the People Act, 1951, based on the finding that the appellant, who claimed to belong to the Scheduled Caste Cheramar, was actually a Christian and thus not qualified under Section 4(a) of the Act. The Court emphasized that only individuals who are Hindus can be considered members of Scheduled Castes as per the Constitution (Scheduled Castes) Order, 1950. Consequently, the Court affirmed the High Court's ruling that the improper acceptance of the appellant's nomination materially affected the election results.
