The Supreme Court held that the assessment of whole body disability at 29% by the Tribunal was justified and should not have been reduced to 15% by the High Court. The Court emphasized that the appellant's injuries warranted a higher compensation due to the significant impact on his earning capacity. Consequently, the Court enhanced the total compensation to Rs.1,48,200/- with interest at 6% per annum, thereby allowing the appeal under Section 166 of the Motor Vehicles Act, 1988.
