The Supreme Court held that the Central Administrative Tribunal's directive to the Railway Board to formulate a scheme for the regularization of employees of a co-operative society was illegal, as it encroached upon the executive domain, violating the separation of powers principle under the Constitution. The Court reiterated that the judiciary cannot issue directions for executive functions, as established in Union of India [Railway Board] & Ors. Vs. J.V. Subhaiah & Ors. (1996) 2 SCC 258. Consequently, the Court set aside the Tribunal's order and the High Court's judgments, allowing the appeals.
