Judgment text excerpt

The Supreme Court, in this case, reaffirmed the principle established in Mulla v. State of U.P. (2010) 3 SCC 508, stating that while sentencing courts can prescribe the length of incarceration, the power to commute sentences or grant remissions lies with the Government. The Court held that life imprisonment should extend to the full life of the convict, subject to any remission granted by the Government. The appeal was dismissed, but the Court directed the State Government to decide on the appellant's continued detention or release within six months, considering the appellant's custody since January 10, 1989.
