The Supreme Court held that the conviction of the appellant under Sections 13(1)(c) and (d) read with Section 13(2) of the Prevention of Corruption Act, 1988, and under Sections 409, 471, and 477A of the IPC was unwarranted as the evidence indicated only temporary embezzlement without any loss to the department. The Court found that the appellant's actions did not constitute offences under the Prevention of Corruption Act and that the alleged IPC offences were trivial, thus invoking the benefit of Section 95 IPC. The appeal was allowed, and the appellant was acquitted.
