Judgment text excerpt

The Supreme Court upheld the conviction of the appellant under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, for possession of heroin, but modified the conviction from Section 21(c) due to the quantity being less than the commercial threshold of 250 grams. The Court clarified that the appellant was found in possession of 125 grams of heroin, thus reducing the sentence from twelve years to ten years of rigorous imprisonment, while maintaining the fine of Rs. one lakh. The ruling followed the precedent set in E. Michael Raj Vs. Intelligence Officer, Narcotic Control Bureau, 2008 (5) SCC 161.
