The Supreme Court ruled on the validity of an unregistered lease deed under Section 107 of the Transfer of Property Act, 1882, and Sections 17 and 49 of the Registration Act, 1908. The Court established that an unregistered lease deed is unenforceable, thus invalidating the arbitration clause within it. Consequently, the Court upheld the dismissal of the appellant's application for the appointment of an arbitrator, affirming that the appellant could not claim arbitration based on an invalid lease agreement.
