The Supreme Court held that the delay of 305 days in filing a review petition was condoned by the learned single Judge, and thus, the Division Bench should have excluded this period when considering the delay in filing the writ appeal. Consequently, the Court set aside the Division Bench's order, restored the writ appeal, and condoned the delay in filing it, directing the High Court to dispose of the appeal on merits expeditiously.
