Judgment text excerpt

The Supreme Court restored the Special Leave Petition in Criminal Miscellaneous Petition No. 4724 of 2004 and addressed the issue of juvenile status under Section 2(k) of the Juvenile Justice (Care and Protection of Children) Act, 2000. The Court held that both appellants, being minors at the time of the offence under Section 302 read with Section 34 IPC, should not have been sentenced to life imprisonment. The conviction was confirmed based on eyewitness accounts, but the sentence was set aside due to their juvenile status at the time of the crime.
