The Supreme Court held that the order of reinstatement granted by the Tribunal was unsustainable as the respondent's appointment was for a fixed term ending on 6th September 1990. The Court modified the orders to reflect that the respondent would be deemed in service only until that date. Additionally, the Court ruled that the grant of back wages is discretionary and, considering the respondent's conduct and the employer's financial status, no back wages were justified. The appeal was allowed accordingly.
