Judgment text excerpt

The Supreme Court held that the appointment of an arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996 was valid, as the dispute was governed by the arbitration clause in the agreement. The Court clarified that the provisions of the 1983 Madhya Pradesh Madhyastham Adhikaran Adhiniyam apply only in the absence of an arbitration clause. The Court set aside the Madhya Pradesh High Court's ruling that deemed the arbitrator's award as lacking jurisdiction, thereby upholding the arbitrator's authority to decide the dispute.
