Judgment text excerpt

The Supreme Court held that the period of limitation for filing an application under Section 34 of the Arbitration and Conciliation Act, 1996, begins from the date a signed copy of the arbitral award is received by the objector, not from the date a copy is received by any means. The Court found that the appellants received the certified copy of the award on January 19, 2004, and thus their application filed on January 28, 2004, was within the limitation period. The Court reversed the High Court's decision, allowing the appeal and setting aside the order dismissing the application as barred by limitation.
