Judgment text excerpt

The Supreme Court addressed the appeal against the High Court's decision to set aside charges framed under Sections 420, 218, 467, 468, 471 read with Section 120-B IPC against the first respondent and her deceased husband for allegedly manipulating revenue records to illegally transfer government land. The Court held that the High Court erred in finding a lack of opportunity for the accused to be heard and in transferring the case without sufficient grounds. The Court reinstated the charges and emphasized the need for a fair trial under the provisions of the Code of Criminal Procedure, particularly Sections 239 and 240.
