The Supreme Court addressed a writ petition challenging the suspension of the film 'Aarakshan' by the State of Uttar Pradesh under Section 6(1) of the U.P. Cinemas (Regulation) Act, asserting it was ultra vires the Constitution. The Court noted that the States of Punjab and Andhra Pradesh had lifted their suspensions, rendering the petition infructuous for those States. The Court held that the power to censor films lies with the Central Board of Film Certification under The Cinematograph Act, 1952, and that the Uttar Pradesh Government's suspension was unconstitutional as it violated Article 19(1) of the Constitution.
