Judgment text excerpt

The Supreme Court held that the petitioner, being a juvenile at the time of the offence, was entitled to be tried under the Juvenile Justice (Care and Protection of Children) Act, 2000, as amended by Act 33 of 2006. The Court emphasized that the benefit of juvenility must be extended to the petitioner, aligning with the precedent set in Hari Ram vs. State of Rajasthan, (2009) 13 SCC 211. Consequently, the Court directed that the petitioner be released from detention, as his trial was not conducted in accordance with the provisions of the Act, thereby upholding his fundamental rights under Article 21 of the Constitution.
