Judgment text excerpt

The Supreme Court upheld the findings of the Trial Court and the High Court, affirming that the defendants failed to prove their claim of title over the property based on an alleged agreement to sell dated 27th November 1982. The Court reiterated that possession cannot be established solely through an agreement to sell without a registered sale deed, as per the principles of property law. The Court held that the plaintiffs were entitled to declaration and possession of the property, thereby dismissing the appeal of the defendants.
