The Supreme Court held that the Punjab and Haryana High Court's decision to reduce the sentence of the respondent-accused for possession of 26 kilograms of poppy husk under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 was erroneous, as it failed to consider the applicability of the amendments introduced by the amending Act 9 of 2001. The Court referenced Basheer V. State of Kerala (2004) 3 SCC 609, establishing that amendments do not apply to appeals pending as of 2nd October 2001. Consequently, the appeal was allowed, and the matter was remanded to the High Court for a fresh decision.
