The Supreme Court ruled that the Respondent, M/s. Tantia Construction Pvt. Ltd., was not obligated to execute additional work outside the scope of the original contract as per Tender No.76 of 06-07, which violated Articles 14 and 19(1)(g) of the Constitution of India. The Court emphasized that altering the nature of work in a Risk and Cost Tender without proper consent contravenes the principles of natural justice and the General Conditions of Contract. Consequently, the order by the Deputy Chief Engineer was quashed, allowing the Respondent to complete the contracted work without the additional obligations.
