Judgment text excerpt

The Supreme Court held that the High Court erred in reversing the findings of the Rent Control Appellate Authority regarding eviction under Section 11(2)(b), 11(4)(i), and 11(4)(iii) of the Kerala Buildings (Lease and Rent Control) Act, 1965. The Court established that the landlord's right to evict the tenant for arrears of rent was valid and should have been upheld. Consequently, the Supreme Court restored the order of eviction under Section 11(2)(b) and allowed the appeal of the landlords.
