Judgment text excerpt

The Supreme Court ruled that the Respondent Company, M/s. Tantia Construction Pvt. Ltd., was not obligated to execute additional work outside the scope of the original contract as per Tender No.76 of 06-07, which violated Articles 14 and 19(1)(g) of the Constitution of India. The Court held that the Petitioners could not compel the Respondent to undertake work not included in the original agreement, thereby affirming the principles of natural justice and contractual obligations. The order of the Deputy Chief Engineer was quashed, allowing the Respondent to complete the reduced quantity of work and seek payment for the executed contract work.
