The Supreme Court held that the failure of the appellant-University to issue a provisional certificate does not constitute deficiency in service under Section 12 of the Consumer Protection Act, 1986. The Court found that the respondent's claim for compensation was based on an erroneous assumption that the provisional certificate was never issued, which was not substantiated. Consequently, the Court set aside the orders of the National Commission, State Commission, and District Forum, allowing the appeal of the appellant-University.
