The Supreme Court held that the appellant's tenure as a Member of the U.P. State Human Rights Commission, appointed under The Protection of Human Rights Act, 1993, could not be curtailed by the Amendment Act 2006, which came into force after his appointment. The Court emphasized that the amendment could not have retrospective effect to affect accrued rights of the appellant, who was entitled to serve until the end of his five-year term. The appeal was allowed, overturning the High Court's dismissal of the writ petition challenging the notification that declared the appellant ceased to hold office.
