The Supreme Court held that under Section 19 of the Standards of Weights and Measures Act, 1976, and Rules 2, 4, 6, 8, 9, and 23 of the Standards of Weights and Measures (Packaged Commodities) Rules, 1977, a complaint must specify the individual responsible for the day-to-day affairs of a company to be maintainable. The Court found no distinction between the appellant and the Chairman, Mr. H.B.Lal, whose proceedings were quashed by the High Court, and thus quashed the proceedings against the appellant as well. The ruling emphasized the necessity of identifying responsible individuals in corporate liability cases.
