Judgment text excerpt

The Supreme Court held that the detention order under the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug-offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, and Slum Grabbers and Video Pirates Act, 1982, was invalid as it did not provide sufficient grounds for detention as required under Section 3(1) of the Act. The Court emphasized the necessity of clear and specific allegations to justify preventive detention, thereby quashing the detention order and ordering the release of the detenu, Ramakrishnan. The appeal was allowed on this singular ground, rendering the previous dismissal by the High Court erroneous.
