The Supreme Court addressed the appellant's claim for gratuity under Section 4(6) of the Payment of Gratuity Act, 1972, and Section 5(1)(a)(i) of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955. The Court held that since there was no evidence of damage or misconduct justifying forfeiture of gratuity, the denial of the appellant's claim was unjustified. The Court ultimately reversed the High Court's decision, allowing the appellant's claim for gratuity.
