The High Court of Judicature of Andhra Pradesh held that the appellants, who were the plaintiffs, were entitled to recover possession of the premises after the Gram Panchayat vacated the property. The court noted that the only dispute was regarding the area for which court fees were paid, which was limited to 110 sq.yards. Since the respondents had vacated the premises and the appellants had taken possession, the court set aside the impugned judgment and disposed of the appeal without further directions, ordering each party to bear its own costs.
