Judgment text excerpt

The Supreme Court upheld the constitutional validity of the Notification dated 23.1.2004 under Section 4 and the declaration dated 18.1.2005 under Section 6 of the Land Acquisition Act, 1894, as well as Section 23(1) of the Act and the Punjab New Capital (Periphery) Control Act, 1952. The Court ruled that the government's action to exempt certain areas from the provisions of the Punjab Regional and Town Planning and Development Act, 1995 was valid, emphasizing that legal impediments affecting a small percentage of land should not hinder the overall development plan. The appeals against the High Court's dismissal of the writ petitions were therefore dismissed, affirming the government's acquisition process.
