The Supreme Court upheld the Kerala High Court's decision that the assignment deed (Ext. A3) executed by Kunjali in favor of Abdul Kadar constituted a surrender of tenant rights, which is prohibited under Section 51 of the Kerala Land Reforms Act, 1963. The Court affirmed that such a surrender cannot be made to a party other than the Government, thereby validating the High Court's interpretation of the deed. Consequently, the appeals filed by Amina Beevi and the State Bank of Travancore were dismissed, affirming the lower court's decree in favor of the plaintiffs.
