Judgment text excerpt

The Supreme Court upheld the dismissal of the Letters Patent Appeal, confirming the order of the Single Judge which had dismissed the Writ Petition challenging the rejection of objections under Section 10(3) of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961. The Court established that the determination of family holding under the Ceiling Act must consider the status of family members on the relevant date, and since Rabindra Kumar Singh was found to be a major on that date, he was entitled to be treated as a separate family. The Court held that the earlier order recognizing this status was final and binding, thus affirming the findings of the lower authorities regarding surplus land.
