The Supreme Court upheld the Allahabad High Court's dismissal of Writ Petition No.16819 of 2003, affirming the imposition of penalty by The New Okhla Industrial Development Authority (NOIDA) for failure to execute the lease deed within the stipulated period as per Clause 25 of the Scheme. The Court found that the petitioners had knowledge of the existing irrigation drain on the plot and the terms of the allotment, thus rejecting their claim for waiver of penalty. The Court held that the petitioners were bound by the conditions of the allotment and had no grounds for relief.
