The Supreme Court held that the execution of an arbitral award under Section 36 of the Arbitration & Conciliation Act, 1996, should not occur before the expiry of the time for filing an application to set aside the award under Section 34. The Court dismissed the appeal against the order directing the return of the application for lack of jurisdiction and set aside the order allowing execution of the award, directing the appellant to deposit the amount in the District Court, Puri. The Court emphasized the need for expeditious resolution of the application under Section 34.
