The Supreme Court upheld the decision of the High Court declaring the election of the appellant to the Legislative Council void under Section 123 of the Jammu and Kashmir Representation of the People Act, 1957. The Court found that the appellant, being a resident of District Rajouri, was ineligible to contest for the seat reserved for a resident of Poonch District, as stipulated in Section 50(3) of the Constitution of Jammu and Kashmir. Consequently, the Court affirmed the election of the respondent No. 1, Mr. Mohd. Rashid Qureshi, as the rightful candidate for the seat.
