The Kerala High Court upheld the trial Court's decree for partition of 5.125 cents of land under the Travancore Christian Succession Act 1092, affirming the respondents' entitlement to 2/3rd share of the property after the death of their father, George Puthukkery. The Court noted that the Kuthakapattam rights granted to Stephan George Puthukkery did not negate the respondents' claims to inheritance. The appellate Court's reversal of the trial Court's decree was found to be erroneous, leading to the restoration of the trial Court's order.
