Judgment text excerpt
The Supreme Court held that the compensation awarded for land acquisition cannot be based on the market value of lands from a different locality, as evidenced by the lack of comparability between the lands in Keragalli and Maragowdanahalli. The Court found that the reference Court and High Court erred in relying on a previous award from Maragowdanahalli, which was not substantiated by adequate evidence. Consequently, the Court set aside the compensation amount of Rs.13,49,000/- per acre and emphasized the need for proper evidence to determine market value, thus allowing the appeal.
