The Supreme Court set aside the Delhi High Court's judgment which upheld the cancellation of the Indane Gas distributorship of appellant No. 2, a war widow, on grounds of misrepresentation and loss of control over the partnership firm. The Court held that despite her ill health, appellant No. 2 retained 51% shares and thus maintained control, emphasizing a liberal approach towards widows and vulnerable individuals. The Court directed the respondents to resume gas supply to the appellants as per the agreement dated 15.2.2007.
