Judgment text excerpt
The Supreme Court addressed the issue of load reduction under the U.P. Electricity Supply Code, 2005, and the Sick Industrial Companies (Special Provisions) Act, 1985. The Court held that the Respondent-Company's request for load reduction from 8 MVA to 1.25 MVA was valid and should have been honored by KESCO, as the agreement was made in accordance with the Electricity Supply Code. The Court emphasized that the Respondent's compliance with the provisions of SICA did not negate its obligation to pay for electricity based on the agreed load, thus ruling in favor of the Respondent-Company.
