The Supreme Court upheld the decision of the Central Administrative Tribunal, which ordered the re-fixation of pay for respondents who were Assistant Superintendents in the National Sample Survey Organisation. The Court ruled that the special pay of Rs.75, which was to be merged with the basic pay as per the Fourth Pay Commission recommendations, should also be considered in the revised pay scale of Rs.1600-2660 effective from 01.01.1986. The Court modified the High Court's judgment to ensure that the special pay is included in the revised pay scale as per the Fifth Pay Commission recommendations, thereby affirming the entitlement of the respondents to arrears of salary due to this re-fixation.
