The Supreme Court upheld the dismissal of a writ petition challenging the retirement age of auctioneers in the Market Committee under Rule 24(5) of the Punjab Agricultural Produce Markets General Rules, 1962. The Court found that the instructions issued by the Chief Administrator, which mandated a retirement age of 60 years, were authorized by Section 33(4)(ii) of the Punjab Agricultural Produce Markets Act, 1961. The Court ruled that the auctioneers, being engaged on a commission basis and not as employees, could not claim continuation of service beyond the stipulated age limit.
