The Court upheld the Kerala High Court's decision, which recognized that the respondent's prior service in the aided school should be counted towards his eligibility for continued service. The Court clarified that the provisions of KSR, established under Article 309 of the Constitution of India, support the respondent's claim for continuity in service.
