Judgment text excerpt
The Supreme Court addressed the challenge by the Secretary of Cannanore District Muslim Educational Association against the non-sanctioning of Higher Secondary courses under the Pre-degree Courses (Abolition) Act, 1997. The Court held that the denial of sanction for Higher Secondary courses was discriminatory and violated the principles of equality and fair opportunity as enshrined in Article 14 of the Constitution. The Court directed the respondents to consider the appellant's application for Higher Secondary courses in light of the assurances previously given, thereby upholding the appellant's right to educational opportunities.
