JAFARIA vs UNION OF INDIA & ORS.

The Supreme Court ruled that the confinement of the petitioner, Mr. Jafaria, was contrary to Article 21 of the Constitution of India, which guarantees the right to life and personal liberty. The Court noted that the State of Rajasthan had no objection to the release of the petitioner, and the Government of India had decided to repatriate him to Pakistan on 25th March 2010. Consequently, the writ petition for Habeas Corpus was disposed of as no further directions were necessary.
