The Supreme Court set aside its previous judgment in Criminal Appeal Nos. 1362-1363 of 2004 due to a violation of natural justice, as the acquittal of four accused was reversed without affording them an opportunity to be heard. The Court held that all accused must be impleaded and served with notices before any judgment can be rendered against them. Consequently, the earlier conviction under Section 304 Part-II read with Section 149 IPC was recalled, and the appeals were restored for fresh hearing.
