The Supreme Court set aside its previous judgment in Criminal Appeal Nos. 1362-1363 of 2004 due to a violation of natural justice, as the acquittal of four accused was reversed without them being made parties to the appeal. The Court held that all accused must be afforded an opportunity to be heard before any conviction can be upheld, thus restoring the appeals for fresh hearing. Consequently, the accused Sughar Singh, Laxman, Onkar, and Ramesh were ordered to be released if in custody, while the other four accused were to be impleaded and served with notices.
