Judgment text excerpt
The Supreme Court ruled that individuals holding degrees or diplomas of 'Vaidya Visharad' or 'Ayurved Ratna' from Hindi Sahitya Sammelan Prayag, which are not recognized under Schedule II of the Indian Medicine Central Council Act, 1970, do not have the right to practice medicine. The Court upheld the validity of the cut-off date of 1967 as per Entry No. 105 in the Second Schedule of the Act, 1970, and found that the restrictions imposed by the Act do not violate Article 14 of the Constitution. Consequently, the appeals were dismissed, affirming the High Court's decision that those obtaining qualifications after the enforcement of the Act in Rajasthan are ineligible to practice.
